PAYMENT TERMS
Terms of payment are cash and/or bank / credit / debit card.
LIMITATIONS AND WARRANTIES
No warranties, express or implied, are made by us in connection with the sale of items. Such warranties made in connection with the sale of new, complete
units are made exclusively by a statement of warranty packaged with such units, and Western Auto Associates d/b/a Western Auto and Home Associates
assumes nor authorizes any person to assume for it any obligation or liability whatever in connection with the products sold. WARRANTIES ARE
HONORED BY THE RESPECTIVE MANUFACTURER.
LIMITATION OF LIABILITY
Western Auto Associates d/b/a Western Auto and Home Associates shall not be liable hereunder for damages, injuries, and/or death on any products
sold, including PowerSports & Trampolines. Liability falls strictly with the manufacturer and/or end user. In no event shall Western Auto Associates d/b/a
Western Auto and Home Associates be liable for loss of profit or good will or for any other special, consequential, or incidental damages.
CONDITION SALE (Credit Customers)
We shall retain title to all items hereby purchased by you until all sums owing hereunder are fully paid in cash. Our security interest shall include any
proceeds realized by you upon the sale of such items. Should you in any way default hereunder, or should your financial responsibility be reasonably
deemed by us to be unsatisfactory, the entire balance owing hereunder shall, at our election, become immediately payable without notice and we may, in
addition to other lawful remedies, seize such items without legal process and, at our option, either retain them in full satisfaction of your obligations
hereunder or dispose of such items at public or private sale, retaining from the monies realized there from an amount sufficient to pay the balance due,
plus the expenses of retaking and resale, and reasonable attorney’s fees. Any surplus realized by us on such resale shall be returned to you but you
shall remain liable for any deficiency.
SALES TAX
Western Auto Associates d/b/a Western Auto and Home Associates is business licensed in the State of Alabama and complies with the Sales Tax Laws
within the State of Alabama. All merchandise shipped outside of the State of Alabama is exempt from Alabama Sales Tax. It is the responsibility of the
purchaser to comply with the sales tax laws of localities outside of the State of Alabama.
Orders shipped within the State of Alabama incur a 4% sales tax. Orders shipped within Vestavia Hills, Alabama incur an additional 4%.
BACKORDERED ITEMS
Due to the high cost of freight, we have temporarily amended our backorder policy. The temporary policy enables to keep your order's shipping charges
below $10 while maintaining our normal policy would have raised your order's shipping charges significantly, even if your order didn't contain backordered
items.
Current Policy (until further notice): When a Backordered item is included in your order, we will hold shipment of the entire order until all items are
available. We will notify you if this is expected to be an extended period of time and will also provide other options for substitutes when available. You may
opt for a refund if you do not feel the timeframe will meet your needs.
Temporarily Suspended Policy(until further notice): Backordered Items will ship as soon as they are available. No additional shipping cost will be charged.
Purchaser may cancel backordered portion of order before it ships. Once backordered portion of order ships, Exchange & Return Policies apply.
RETURNS & EXCHANGES
No Returns or Exchanges on Closeout Items, Special Orders, Auto Parts, Special Application Small Engine Parts, PowerSports, LoadLite Tailgate Ramps,
Small Engine & Mower Accessories, Electronics. Trampolines, and Food & Beverage Products.
To qualify for credit on exchangeable/returnable items, exchanged/returnable item(s) must be clean, without blemish, including all parts, with the original
packaging intact and clean. Items with Damaged Packaging will not receive credit. Rhino Tuff Trimmer Heads may be exchanged for the proper fit or
KwikLoader head should there be an error in application. KwikLoader Trimmer Heads may be exchanged for the same reasons provided we checked the
model of your trimmer at your request prior to shipping.
Returns for mattress and bedding products: Follow the instructions included in the order. Mattress & bedding returns are facilitated by our bedding
manufacturer, InnerSpace. InnerSpace offers a 30-day no obligation sleep test on all of our Mattress & Bedding Products.
